The present application u/s 482 Cr.P.C. has been moved on behalf of applicant seeking the quashing of recovery warrants dated 02.02.2017 and 30.01.2018 issued by the Additional Chief Judicial Magistrate, Court No.6, Aligarh in Case Crime No.1189 of 2016, u/s 31 of the Protection of Women from Domestic Violence Act, P.S.-Quarsi, District-Aligarh.
Heard learned counsel for the applicant and learned A.G.A. and also perused the record.
It has been brought to the notice of the Court by the counsel that an appeal against the original order in consequence of which recovery proceedings have been initiated, has already been filed in the lower appellate court. In such circumstances, this Court does not find it proper to exercise its inherent jurisdiction. Whatever relief applicant wants to get, must be sought in the lower appellate court.
The application lacks force and therefore same stands dismissed.
