JUDGMENT / ORDER

Party-in-person, Mr.Jatinkumar Hiralal Shah, who is personally present in Court, has submitted that Mr.Masoom K.Shah is no more representing him as the learned advocate and that he will personally argue the matter.
Rule. Mr.L.B.Dabhi, learned APP waives service of notice of rule on behalf of opponent-State.
Heard applicant as party-in-person and learned APP, Mr.Dabhi for the State.
At the end of arguments, the applicant restricted his prayer qua modification of condition No.6(e) of the order dated 13-3-2012 passed in Cri.Misc.Appln.No.2406 of 2012 to the extent that he may not be permitted to leave India without prior permission of Sessions Court concerned.
Having regard to the facts and circumstances of the case and in view of the fact that the applicant has been scrupulously observing all the conditions imposed on him, this application is partly allowed. Condition No.6(e) of the order dated 13-3-2012 passed in Cri.Misc.Appln.No.2406 of 2012 of not to leave Gujarat is modified to the extent that the applicant shall not leave India without prior permission of Sessions Court concerned. All the other conditions imposed on the applicant in the order passed on 13-3-2012 in Cri.Misc.Appln.No.2406 of 2012 will remain unaltered. Rule is made absolute to the aforesaid extent. D.S. is permitted.
