This writ petition has been filed by the petitioner, interalia, for the following reliefs:
"I. A writ, order or direction in the nature of mandamus directing the Respondent authorities to carry out the survey for the purpose of Section 15 of U.P. Sugar Cane (Regulation of Supply and Purchase) Act, 1953 with respect to the Khata No. 207, having Plot No. 150/5, 251/3, 155, 156, 158/1 Total Measuring 11.970 hectors, situated at Gram Kabirganj, Pargana and Tehsil Puranpur, District Pillibhit, belonging to the Petitioner.
II. A writ, order or direction in the nature of mandamus directing the Respondent authorities that in case the land is found to be fit, the same is to be declared as reserved area for the "Sahkari Ganna Vikas Samiti Ltd. Sampoorna Nagar, Lakhimpur Khiri" and consequential agreement as contemplated under Order 4 of U.P. Sugarcane Supply and Purchase Order, 1951 may be entered."
Heard learned counsel for the petitioner, learned Standing Counsel appearing on behalf of the Respondents No. 1 to 3, Sri Ravindra Singh, learned counsel for the Respondent No. 4 and perused the record.
Learned counsel for the petitioner has stated that he has already submitted his representation dated 10.8.2019 before the Respondent No. 3, District Cane Officer, Lakhimpur Khiri which is still pending and no order has yet been passed on it.
Considering the facts and circumstances of the case, we direct the Respondent No. 3, District Cane Officer, Lakhimpur Khiri to take a decision on the representation of the petitioner dated 10.8.2019 expeditiously preferably within a period of one week from the date of receipt of a certified copy of this order, a copy of the writ petition and its annexures.
It is made clear that we have not expressed any opinion on merits of the case and the Respondent No. 3 would be at liberty to decide the representation of the petitioner on its own merit.
With the above observation, this writ petition is finally disposed of.
