Mr Pandya learned APP waives service of rule onbehalf of the State.
By way of this application, the applicant-convict, who is present before this Court and at present enjoying the temporary bail pursuant to the earlier order passed by this Court and he is to surrender before the jail authority on 3.5.2012, has prayed that the time to surrender before the jail authority be extended in view of the operation of his mother, which is performed on 28.4.2012.
From the papers, we find that the father of the applicant-convict is there and coupled with the fact that the operation is already performed, we are not inclined to extend the time to surrender before the jail authority. Hence, discretion does not deserve to be exercised. The application is rejected. Rule is discharged.
