This application under Section 482 Cr.P.C. has been filed with the prayer to direct the court below to decide the application dated 23.3.2018 moved by the applicant for quashing of the proceedings under Section 128 Cr.P.C. in the criminal Case No. 38 of 2013, Akali vs. Jangbahadur expeditiously.
Heard learned counsel for the applicant and learned A.G.A. for the State. Perused the record.
Only submission made by the counsel for the applicant before the Court is that there is some application dated 23.3.2018 moved before the court below but no order has been passed on the same so far. Therefore, some direction to get the application decided may be issued by this Court.
This Court in the absence of complete record is not in a position to know about the exact status of the proceedings or the circumstances under which the aforesaid application has been moved and why the said application is still pending. At any rate, this application stands disposed of with the observations that if there is some application dated 23.3.2018 pending before the court below and no orders have been passed upon the same by now, the court below is directed to look into the same and pass appropriate orders as it may deem fit expeditiously in accordance with law.
