Heard learned counsel for the applicant, Sri G.S.D. Mishra for the informant/complainant, Sri Vikas Sahai, the learned A.G.A. for the State and perused the record.
The instant bail application has been moved seeking anticipatory bail in light of the apprehension of the arrest of the applicant in Case Crime No. 783 of 2018, under Sections 420, 467, 468, 471, 506 I.P.C., Police Station Shahganj, District- Agra.
Sri Vikas Sahai, the learned A.G.A. on instructions points out that a proclamation under Section 82 Cr.P.C. has been issued against the applicant. In view thereof, it is manifest that this application cannot be maintained in light of the law as enunciated by the Supreme Court in Lavesh Vs. State (NCT of Delhi), (2012) 8 SCC 730.
The application is consequently rejected.
