THESE WRIT PETITIONS COMING ON FOR PRELIMINARY HEARING THIS DAY, THE COURT MADE THE FOLLOWING:
O R D E R Sri Rahamathulla Shariff, learned counsel for the petitioners. Perused the records.
2. In this petition under Articles 226 and 227 of the Constitution of India, the petitioners inter alia have assailed the validity of the notice dated 23.03.2019, issued under Section 13(2) of SARFAESI Act read with Rule 3 of the Security Interest (Enforcement) Rule, 2002.
3. When the matter was taken up today, learned counsel for the petitioners submitted that the aforesaid demand notice has been issued by the petitioners by way of publication. Therefore, the petitioners were unable to file objections within the time limit prescribed in the statute. It is further submitted that in case the petitioners are granted two weeks’ time, they shall file the objections to the same.
4. In view of the aforesaid submission and in the facts of the case, the petitions are disposed of with a direction that in case the petitioners file objections to the aforesaid demand notice within a period of two weeks from the date of receipt of certified copy of the order passed today, the respondent - Bank shall decide the objections preferred by the petitioners before proceeding further with the matter.
With the aforesaid directions, the petitions are disposed of.
