Heard Sri S.A. Ansari holding brief of Sri K.A. Ansari, learned counsel for the petitioner and Sri Girish Vishwakarma, learned standing counsel for the State-respondents.
The only grievance of the petitioner is that by the impugned order dated 17.11.2007 passed by the District Inspector of Schools, Bareilly, payment of interest on delayed payment of gratuity/pension has been denied.
In paragraph Nos. 18 and 19 of the counter affidavit it has been stated that the papers were forwarded by the District Inspector of Schools to the Deputy Director of Secondary Education. The amount was sanctioned and the payment was made.
Interest is a normal accretion of capital. The petitioner was not at fault. The respondents have delayed the payment.
In view of the aforesaid, the writ petition is allowed. The impugned order denying the interest to the petitioner, is hereby quashed.
The respondents are directed to make payment of simple interest to the petitioner @ 6% per annum expeditiously, preferably within a period of six weeks from the date of presentation of a certified copy of this order.
The writ petition is disposed of.
