Heard learned counsel for the petitioner and learned Standing counsel for the State-respondents.
This writ petition has been filed for mandamus commanding the respondent to include the petitioner in the list of employees working on 1.8.1985 by the U.P. Forest Corporation, for the purpose of his appointment /absorption. The petitioner further seeks writ of mandamus commanding the respondent to make appointment of the petitioner with retrospective effect with all consequential benefits.
Petitioner was engaged as Chowkidar on daily basis on 6.5.1983 in the U.P. Forest Corporation. Subsequently he worked in said department up to 1.8.1985, thereafter he was not permitted to work.
Learned counsel for the petitioner placed reliance upon the judgment passed by the Apex Court in Civil Appeal No. 1603 of 1998 vide order dated 24.5.1989 .
The present writ petition has been filed in the year 2003 i.e. after a lapse of more than 18 years, and that too without explaining the latches or any application for condonation of the inordinate delay.
In view of the facts stated above, the writ petition has no merit and is accordingly dismissed. No order as to costs.
