Learned counsel for the applicants submits that a dispute between the parties has a flavour of civil nature and a litigation is pending accordingly, but, no case is made out to put the criminal machinery in motion by a cryptic order dated 29.11.2011 passed by the learned Chief Metropolitan Magistrate, Ahmedabad, under Section 156(3) of the Code of Criminal Procedure, 1973.

Issue notice returnable on 7.5.2012.

Ad-interim relief in terms of paragraph 17(b).

Learned APP waives service on behalf of the State.

Direct service is permitted qua the private respondent.
