Heard learned counsel for the petitioner and learned Standing Counsel appearing for the respondents.
The petitioner has retired from post of Senior Technical Assistant Group 'B' on 31.07.2018 from the office of respondents no.4-District Agriculture Officer, Muzaffar Nagar, District Muzaffar Nagar.
The grievance of the petitioner is that his post retiral dues i.e., G.P.F., Gratuity, Earned Leave, Encasement, Computation of Pension have not been paid by the respondent authorities. The petitioner challenged his retirement notice dated 31.07.2018 before this Court by means of filing a Writ Petition No.20912 of 2018 on the ground that his date of birth is not correct, but the said writ petition was dismissed as not pressed by this Court vide order dated 15.10.2020 and the said order was communicated to the respondent authorities by the petitioner by an application dated 30.07.2020, but the respondent authorities being annoyed of the same, has not paid his post retiral dues.
Learned counsel for the respondents submits that no useful purpose would be served in keeping the writ petition pending and appropriate direction may be issued to respondent no.4 to consider the grievance of the petitioner.
Considering the facts and circumstances of the case and without going into the merits of the case and with the consent of the parties, the writ petition is disposed of with liberty to the petitioner to file a fresh representation before the respondents no.4-District Agriculture Officer, Muzaffar Nagar, District Muzaffar Nagar, along with a copy of this order downloaded from the official website of High Court, Allahabad, raising all his grievances within a period of two weeks from today. In case, any such representation is filed by the petitioner, the respondent no.4 shall consider and decide the same by a reasoned and speaking order preferably within a period of two months thereafter.
The writ petition is disposed of subject to the observations made above.
