The writ petition has been filed for issue of mandamus directing the Investigating Officer to fairly investigate the case registered as Case Crime No. 0113 of 2018, under Section 308, 323 IPC, P.S. Paschimsarira, Distt. Kaushambi.
Counsel for the petitioner submits that the FIR was lodged on 15.7.2018 but the police is not proceeding with the matter.
In the facts of the case, the writ petition is disposed of with direction to Superintendent of Police, Kaushambi and Station House Officer, P.S. Paschim Sarira, distt. Kaushambi, respondents- 2 and 3 to ensure fair investigation in Case Crime No. 0113 of 2018, under Section 308, 323 IPC, P.S. Paschim Sarira, Distt. Kaushambi and submit police report under Section 173 (2) Cr P C as early as possible.
