(Cr.No.152 of 2005) .. Respondent Criminal Appeal filed under Section 374 (2) Cr.P.C. against the judgment of conviction passed by the learned Principal Sessions Judge, Dharmapuri in S.C.No.26 of 2008, dated 30.06.2009 and set aside the conviction and sentence.
Challenging the order passed in S.C.No.26 of 2008, dated 30.06.2009 by the learned Principal Sessions Judge, Dharmapuri, the present criminal appeal has been filed by the appellant.
2. When the above Criminal Appeal was taken up for hearing on 10.02.2017, the learned counsel for the appellant has submitted that pending the appeal, the sole appellant died on 28.06.2013.
3. The learned Government Advocate (Crl.side) has verified the same and filed a true copy of death certificate of the appellant dated 06.07.2013.
4. Recording the true copy of the death certificate dated 06.07.2013 on the death of the sole appellant, the Criminal Appeal is dismissed as abated.
