The petitioners, who have retired from the post of Assistant Teacher at Kisan Inter College, Dundipura, Khediya District Agra are aggrieved by wrong fixation of their pension. They claim that their continuous service since the date of initial appointment has not been counted for the purpose fixation of pension on account of the fact that for certain period, the Management contribution to the contributory of provident fund had not been deposited. They have placed reliance upon the judgment of this Court in Writ A No. 17819 of 2007 Mangali Prasad Verma Vs. State of U.P. and others. They have already filed representation before the second respondent on 25.9.2017 and the submission is that the same may be directed to be decided within a specified time, to which learned standing counsel appearing on behalf of State-respondents does not have any objection.
Accordingly, the writ petition is disposed of by directing the second respondent to decide the representation of the petitioners dated 25.9.2018 in the light of law laid down by this Court in Mangali Prasad Verma (supra) by passing a speaking order within a period of next three months from the date of production of a certified copy of this order alongwith photocopy of the representation.
