Heard Shri Rudra Pratap Singh, learned counsel for the petitioners and learned Standing Counsel as well as Shri Sanjay Kumar Tripathi, learned counsel on behalf of the Nagar Nigam, Gorakhpur.
The relief prayed in the writ petition is that the order dated 08.6.2016 passed by the Nagar Nigam, Gorakhpur, respondent No. 4 may be quashed since it deprives that the benefit of the Government order dated 23.9.2014 to employees working at other places, since it was issued only in respect of the employees working at Lucknow. The order was challenged on the ground that it is discriminatory in nature and the petitioner should be accorded parity with the employees working at Lucknow regarding the benefits coming from the Government order dated 23.9.2014.
Learned Standing Counsel has filed personal affidavit of respondent No.2, wherein the order dated 1st of August, 2017 has been annexed as Annexure No. CA-16, which states that the benefit of the Government order cannot be granted to the petitioners. The order is a non-speaking and unreasoned order.
The counsel for the petitioners has made a statement that he intends to challenge this order by means of a separate writ petition and, therefore, this writ petition is dismissed with liberty to the petitioners to assail the order dated 01.8.2017 passed by the State Government by means of another writ petition.
This writ petition is dismissed subject to liberty prayed above.
