Heard Sri Satish Kumar Yadav, learned counsel for the applicant, Sri Gaurav Pratap Singh, learned A.G.A. for the State and perused the record.
The first bail application of the applicant was rejected by this Court on 12.05.2015. Thereafter the second bail application of the applicant was also rejected by this Court on 12.05.2017. This is the third bail application on behalf of the applicant.
It has been argued by learned counsel for the applicant is that the applicant is in jail since 27.01.2013 and the trial has not been concluded till date. Learned counsel for the applicant further states that statement of all witnesses of fact have been recorded by the trial court and only formal witnesses are left.
Learned A.G.A. opposed the prayer for bail and submitted that the first bail application of the applicant which was rejected by this Court on 12.05.2015 was on merits of the case.
Without expressing any opinion on the merits of the case and considering the submissions advanced, I find that no good ground is made out for enlarging the applicant on bail.
The bail application of the applicant Jai Kumar involved in case crime no. 343 of 2012, under Section 364-A, 302, 201, 419 and 420 I.P.C., P.S. Ghiror, District Mainpuri is, accordingly, rejected.
However, the trial court is directed to expedite the trial of the aforesaid case and conclude the same within a further period of six months on day to day basis from the date of production of certified copy of this order before the trial court if the same has already not been concluded.
The applicant is directed to produce the certified copy of this order before the trial court for its compliance.
