This petition alleges disobedience of an order passed on 4 December 2017 requiring the competent authority to consider the grievance of the applicant with respect to an alleged encroachment made on public utility land. This exercise as per the order of the Court was to be completed within a period of three months from that date. It is not disputed that after an inquiry is initiated, statutory proceedings referable to Section 67 of the U.P. Revenue Court, 2006 must be initiated and thereafter disposed of in accordance with law and with due notice to the alleged encroachers. In many such cases, which have come before this Court, they also entail demolition of established permanent constructions. Bearing all these aspects in mind, this Court find itself unable to initiate proceedings in contempt at this stage.
The petition is consequently dismissed with liberty to approach again in case the matter is inordinately delayed.
