Heard Shri Pramod Jain, learned counsel for the petitioners and Shri Ramendra Pratap Singh, learned counsel for the respondents no. 2 to 4. Learned Standing Counsel represents respondent no. 1.
The case of the petitioners is that they had been allotted certain area of land without actual demarcation of the plot number by Greater Noida, Industrial Development Authority, pending finalization of acquisition of land holding. It is stated that despite such allotment neither the plots have been carved out nor actual possession of the area to be allotted to the petitioners have been so transferred. It is however, admitted on record that the petitioners continued in possession much in excess land allotted to them. It is contended that a lay out plan for the purpose has also been prepared and was handed over to the petitioners.
In our opinion the controversy between the petitioners and the authority must be brought to an end without any unnecessary delay and therefore, in the facts and circumstances of the case, we deem it fit and proper to permit the petitioners to raise their grievances before respondent no. 3 without four weeks from today alongwith certified copy of the order, who shall call for the record and pass a reasoned speaking order, preferably within eight weeks thereafter. All consequential actions shall be taken accordingly.
With the above observations the petition is disposed off.
