Sri Sachindra Upadhyay learned counsel has put in appearance on behalf of respondent nos.2 to 5.
The present petition has been filed jointly by Jagran Prakashan Ltd. and the working journalist of the said company with the prayer to issue a direction to the Employees' Provident Fund Organization through Central Provident Fund Commissioner to settle the claims of the petitioners and all other similarly situated employees of the petitioner-company seeking grant of higher pension on higher salary.
So far as the submission of learned counsel for the petitioner that the competent authority to settle the dispute is the respondents, no objection could be raised by the learned counsel for the respondents. Only this much is submitted by him that certain clarifications have been sought by the Regional Provident Fund Commissioner from the office of Central Provident Fund Commissioner and waiting the same, issue could not be addressed till date.
In view of the aforesaid, it would be appropriate to issue a direction to the competent authority to address the dispute raised by the petitioners and other similarly situated employees of the petitioner- company after seeking clarifications from the concerned authority. An expeditious decision is required to be taken preferably within a period of two months from the date of submission of certified copy of this order.
It goes without saying that this court has not entered into the merits of the claim of the petitioners herein. It would be open for the competent authority to consider their claim in accordance with the statutory provision or the relevant Government orders and take a decision in accordance with law.
