1. The present Civil Application has been preferred by the applicant herein
- original respondent - plaintiff for following reliefs :
"6(A) Allow this Civil Application and direct the trial court to release the amount deposited by the present appellants before the trial court on 27.7.2009 pursuant to orders dated 24.7.2009 in the interest of justice.
(B) Direct the Registry of this Hon'ble Court to list the main matter being Second Appeal No.190 of 2007 for final hearing immediately by calling for Records and proceedings of the record from the Courts below."
2. Mr.Hasit Joshi, learned advocate appearing on behalf of the applicant does not press the present application qua prayer in terms of Para - 6(A), if this Court is inclined to fix early date of hearing of the main Second Appeal.
3. In view of the above, the present Civil Application is disposed of by directing the Registry to notify the main Second Appeal for final hearing in the week commencing from 2nd July,2012.
In the meantime, if the Fixed Deposit is already matured, the same shall be renewed from time to time till final disposal of the main Second Appeal initially for a period of one year at a stratch and the same be continued to be renewed from time to time, without any further order on that aspect.
