Heard learned counsel for the applicant and learned Standing Counsel.
By means of this contempt application, non compliance of the order dated 20.01.2021 passed in writ petition no. 101 of 2021 is complained of.
On the last occasion, instructions were obtained by learned Standing Counsel and copy thereof had been supplied to the applicant to verify the same from his client.
Learned counsel for the applicant submits that though decision has been taken by passing an order on 12.09.2021 by the competent authority calculating the interest and entitling the applicant to be paid, calculations are not proper and more interest would be due to the applicant if calculations are rightly done.
In the considered opinion of the Court, the Writ Court did not apply its mind to the merits of the claim pleaded in the writ petition and simply directed the authority to consider the grievance of the a applicant and redress the same. If the applicant's interest amount is wrongly calculated and is due as per calculation, it would be a fresh ground to further initiate proceeding at appropriate forum.
In the considered opinion of the Court the order of writ court has stood complied with and no cause, therefore, survives to continue this contempt application. It is always open for the applicant to challenge the order of the competent authority in appropriate proceeding at appropriate forum.
Contempt application is accordingly consigned to record.
