Counsel for the opposite party no.2 has contended that the matter was referred to the mediation centre of this Court vide order dated 28.06.2019 and from the perusal of the mediation report, it is clear that mediation has failed between the parties. He further submits that the matter was sent to the mediation centre on the basis of wrong facts stated by counsel for the applicant, which also transpired from the order dated 28.06.2019, wherein counsel for the applicant has stated that it is a matrimonial dispute between husband and wife on the other hand, from the perusal of the summoning order and prayer sought by the applicant, it is clear that the matter is under Section 138 of Negotiable Instruments Act.
In view of above, the instant 482 Cr.P.C. application is mis- conceived, accordingly, it is dismissed.
