Heard learned counsel for the petitioners; the learned A.G.A. for the respondents 1 and 2; Sri Mohit Kumar for the respondent no.3; and perused the record.
The instant petition seeks quashing of the first information report dated 26.11.2019 registered as Case Crime No. 0261 of 2019 at P.S. Hafizpur, District- Hapur, under Sections 147, 148, 149, 307, 302, 323, 504, 506, 34 I.P.C.
The allegations in the impugned first information report disclose a case of murder and five persons are named in the first information report. The allegation is that they formed an unlawful assembly. The petitioners are also named in the first information report.
In view of the above, the prayer of the petitioners to quash the first information report or to interfere in the investigation cannot be accepted.
The petition is dismissed without prejudice to the right of the petitioners to apply for bail.
