In compliance of the earlier order of this Court learned Standing Counsel has placed instructions before this Court, the same is taken on record.
By means of phis petition in the nature of public interest litigation, the petitioner has raised grievance regarding encroachment over a public land of plot No.261/03 area 0.4200 hectares. There is a report of the District Magistrate, Shamli signed by the Tehsildar and Lekhpal of the tehsil and village concerned in which it has come to be recorded that the proceedings under Section 67(1) of the U.P. Revenue Code, 2006 have been instituted against the unauthorized persons for the alleged encroachment, which is registered as Case No. 05/94 of 1995.
In view of the above since the authorities have proceeded in accordance with law and procedure prescribed for, no further orders are required to be passed.
However, it is made clear that the proceedings shall be conducted as expeditiously as possible after giving full opportunity of hearing to the persons who are alleged in the encroachment.
The writ petition is consigned to records.
