The present application u/s 482 Cr.P.C. has been filed before this Court for quashing entire proceeding based upon the Charge Sheet No. 6/2002 dated 05.01.2002 arising out of Case Crime No. 768/2001 and the order dated 16.03.2002 passed by the learned Chief Judicial Magistrate, Etawah.
The interim protection was accorded to the applicant on 25.04.2002. As per the order sheet, this case was listed lastly on 08.04.2019 wherein the following order has been passed which read as under:-
"List before appropriate Bench after obtaining nomination from Hon'ble the Chief Justice."
Today, when the matter was taken up, nobody has appeared on behalf of the applicant.
The present application has been filed by two counsels one of them has already been elevated to Bench and the other has been designated as a Senior Advocate. However, nobody has appeared on behalf of the learned Senior Advocate for adjourning the matter.
Accordingly, in the aforesaid circumstances this Court has no option but to dismiss for want of non prosecution.
However, liberty is accorded to the applicant to move a proper application, if he so desired.
