Heard learned A.G.A. and perused the record.
This revision has been filed against the order dated 28.6.2005 in criminal case no.597 of 2005 arising out of case crime no.37 of 1995, under Section 5/8 of Prevention of Cow Slaughter Act, Police Station-Kankar Khera, District Meerut passed by Special Chief Judicial Magistrate, Meerut whereby eighteen animals were ordered to deliver from the possession of Babu Khan to Smt.Raisa. On the basis of delivery of possession, Smt. Raisa, the widow of Babu Khan was the owner of the animals and the said animals were released from the possession Babu Khan. Later on, Babu Khan died and Smt. Raisa is the legal heirs of Babu Khan, hence she becomes the owner of the said animals.
The impugned order was passed on 28.6.2005. Thirteen years have been elapsed and no useful purpose would be served in keeping the revision pending.
This Court finds no illegality, impropriety, material irregularity or jurisdictional error in the impugned order. No interference is called for.
The present revision is bereft of merit and is hereby dismissed. Interim order, if any, stands vacated.
Certified copy of this order along with the lower court record be sent to the court concerned immediately for compliance.
