Heard learned counsel for the applicant and Shri Devesh Vikram, learned Standing Counsel.
The applicant is before this Court against the wilful disobedience of the order dated 08.03.2019 passed in Public Interest Litigation (PIL) No.516 of 2019 (The Indian Council of Human Rights & Ors. v. Union of India & Ors.), which for ready reference is quoted as under:-
"The learned counsel for the petitioners seeks leave of the Court to implead the State of U.P. as one of the respondent.
Leave is granted.
Necessary amendment, in the memo of parties, be carried out during the course of the day.
The grievance of the petitioners, who claim to be a social worker, is that there are serious allegation of the corruption against respondent no. 5, who is the Executive Officer, presently posted at Nagar Panchayat Mataundh, District Banda and a C.B.I. enquiry be instituted by this Court.
Sri Gyan Prakash, learned Assistant Solicitor General has drawn our attention to a communication sent by the Under Secretary, Government of U.P. to the District Magistrate Banda dated 14th February, 2019, wherein he has asked the comments from the District Magistrate against the respondent no. 5.
We have perused the material placed on the record and the communication of the State Government dated 14th February, 2019. A perusal of the said communication, it is evident that the State Government is seized of the matter and the alleged corruption of the respondent no. 5 is under consideration for the appropriate action before the State Government. Hence, we do not intend to enter into the controversy.
Accordingly, this Public Interest Litigation is disposed of with a direction upon the newly added respondent no. 7 to send a compliance/status report in the matter within three months to the Registrar General of this Court. The Registrar General shall place the status report on the record."
On the matter being taken up today, instructions dated 21.08.2019 have been filed by learned Standing Counsel intimating that the aforesaid order has been complied with and compliance/status report has already been sent to the Registrar General of this Court on 21.08.2019.
Considering the facts and circumstances of the case, the Court is of the opinion that substantial compliance has been made of the order in question. The contempt application stands disposed of. Notices, if any, stand discharged.
