Affidavit filed on behalf of contemnor Ramashankar Singh Rajpoot, in Court today is taken on record.
Heard Sri J.S. Kashyap, Advocate, appearing on behalf of contemnor-opposite party and perused the record.
The contemnor-opposite party has filed an affidavit sworn by him. In para-9 of the affidavit the contemnor-opposite party an unconditional apology has been given. The relevant extract of para-9 is reproduced as under:
"9. That the applicant/opposite party is practicing lawyer in judgeship Agra since 1981 and has never given a chance to annoy the Court concerned and has always submitted himself meekly to the order passed by the Hon'ble Courts. The applicant/opposite party again tenders his unconditional apology with folded hands and prays that his unconditional apology may kindly be accepted and contempt notice issued against the applicant/opposite party be discharged, otherwise, the applicant/opposite party shall suffer irreparable loss and injury and or pass such other further order as this Hon'ble Court may deem fit and proper in the facts and circumstances of the case."
The opposite party-contemnor again tenders his unconditional apology with folded hands and prays that his unconditional apology may kindly be accepted.
In view of the unconditional apology tendered by the opposite party-contemnor is accepted. The notices issued against him hereby discharged. The contempt proceedings are dropped.
However, we are placing the contemnor Chandra Bhan Singh under caution that in case, in future he commits any misconduct or any other act contemptuous on his part is reported to this Court, the Court will take serious view and proceed against him in accordance with law.
Accordingly, the contempt application is disposed of.
