First Appeal No. 1753 of 2012 Learned counsel for the appellant-Insurance Company relies on the order dated 13.7.2005 passed by this Court [Coram: Bhawani Singh, Chief Justice, (as His Lordship then was)] in First Appeal No.3354 of 2000 [National Insurance Company vs. Rasilaben Shantilal Yadav] and submits that the Tribunal has erred in not applying the ratio of the aforesaid case to the facts of the subject appeal and the claim petition.
Considering the above, Admit.
To be heard with First Appeal No.1770 of 2012 Civil Application No. 6938 of 2012 Rule returnable on 16th August 2012.
Ad-interim relief in terms of paragraph 6(i) on the condition that decretal amount of the judgment and award impugned in this appeal be deposited before the Tribunal within four weeks from today.
