2 I.R.Perumal I.A.S. (Retd) .. Respondents Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Certiorari, to call for the records of the 1st respondent in his proceedings in Se.Mu. No.A1/939/ 2016 dated .03.2017 and quash the same.
For Petitioner : Mr.T.Chandrasekaran For Respondents : Mr.A.N.Thambidurai Special Govt. Pleader - for R1 ORDER The petitioner has filed the above writ petition to issue a writ of Certiorari, to call for the records of the 1st respondent in his proceedings dated --.03.2017 and to quash the same.
2. The main grievance of the petitioner is that he was not given an opportunity to put forth his case before the 1st respondent.
3. If the petitioner is aggrieved over the impugned order, an appeal remedy is provided to him before the Appellate Authority, viz., the District Revenue Officer, Chennai.
4. Without exhausting the appeal remedy, the petitioner has filed the present writ petition challenging the impugned order passed by the 1st respondent before this court.
5. Since the petitioner has not exhausted the appeal remedy, I am of the view that the writ petition cannot be entertained. Accordingly, the writ petition stands closed. Liberty is given to the petitioner to challenge the impugned order by way of an appeal before the District Revenue Officer, Chennai, in accordance with law and in the event of the petitioner filing an appeal before the District Revenue Officer, Chennai, the District Revenue Officer, Chennai, is directed to decide the same, on merits and in accordance with law, after giving notice to all the interested parties. No costs. Consequently, connected miscellaneous petition is closed.
