Heard learned counsel for the applicants as well as learned A.G.A. for the State of U.P and perused the material available on record.
Learned counsel for the applicants has contended that the applicants have been shown to be involved in one case registered at Case Crime No.56 of 2020, under Sections 419, 420, 467, 468, 471 I.P.C. and 66 D Information Technology Act, Police Station Jaitpur, District Agra in the gang chart in which they are on bail. Copies of the bail orders have been annexed as annexure no.3 to the affidavit filed in support of the bail application. The applicants are in jail since 24.08.2021 in the present case.
Learned A.G.A. has opposed prayer for bail.
Considering the facts and circumstances of the case, nature of accusation and the severity of punishment in case of conviction and the nature of supporting evidence, reasonable apprehension of tampering with witness or apprehension of threat to the complainant and prima facie satisfaction of the Court in support of the charge, the applicants are entitled to be released on bail. Accordingly, bail application is allowed.
Let the applicants Hukum Singh, Prempal, Maan Singh, Ghanshyam, Parmar and Ashish involved in Case Crime No.112 of 2021, under Sections 2/3(1) U.P. Gangsters and Anti Social Activities (Prevention) Act, 1986, Police Station Jaitpur, District Agra be released on bail on their executing a personal bond and furnishing two sureties each in the like amount to the satisfaction of the court concerned.
