Learned counsel for the petitioner is permitted to make necessary correction in the prayer of the writ petition.
Heard Sri Upendra Upadhyay, counsel for the petitioner, Sri Jitendra Singh, learned A.G.A. for the State and perused the impugned FIR as well as material brought on record.
This petition has been filed by the petitioner with a prayer to direct the respondents specially respondent nos. 2 and 3 to recover the minor daughter of the petitioner who s victim of Case Crime No.200 of 2017, under Sections 363, 366 I.P.C. and Section 4 POCSO Act, Police Station Nidhauli, District Etawah, also to take effective steps for arresting the accused persons and conclude the investigation in the present case in fair manner within a stipulated period.
It has been contended by learned for the petitioner that petitioner is the informant of the present case and he has come up before this Court with a prayer that direction be given to respondent nos. 2 and 3 to recover the minor daughter of petitioner in the present case, arrest the accused persons and conclude the investigation in the matter in fair manner. He further submits that though the FIR has been registered against four accused persons but the police is neither making any attempt to recover the victim girl nor has arrested any of the accused persons in the present case till date.
Considered the facts and circumstances of the case and submissions advanced by learned counsel for the parties.
Considering the facts and circumstances of the case and submissions advanced by learned counsel for the parties, we direct the Investigating Officer of the present case to conclude the investigation of the present case and submit a police report before the Magistrate concerned expeditiously preferably within a period of three months from the date of production of a certified copy of this order.
The S.S.P., Etah is directed to supervise the investigation and ensure that the same is completed speedly without any undue delay and he shall also make efforts for recovery of the victim girl.
With the above directions this petition is finally disposed of.
