Heard learned counsel for the petitioner and learned Standing Counsel appearing for the State respondent no.1 and Sri Pranjal Mehrotra, learned counsel appearing for respondent nos. 2 to 4.
The petitioner has retired from post of Chaukidar on 31.07.2014 from the office of respondents no.4- Executive Engineer, 2nd Construction Division, U.P. Jal Nigam, Ghazipur.
The grievance of the petitioner is that his post retiral dues i.e., Gratuity and arrears of Dearness Allowance have not been paid by the respondent authorities.The petitioner in this respect has made an application on 16.11.2019 before the respondent authorities, but the respondent authorities has neither considered the representations of the petitioner nor has paid his post retiral dues.
Learned counsel for the respondents submits that no useful purpose would be served in keeping the writ petition pending and appropriate direction may be issued to respondent no.4 to consider the grievance of the petitioner.
Considering the facts and circumstances of the case and without going into the merits of the case and with the consent of the parties, the writ petition is disposed of with liberty to the petitioner to file a fresh representation before the respondent no.4-Executive Engineer, 2nd Construction Division, U.P. Jal Nigam, Ghazipur, along with a copy of this order downloaded from the official website of High Court, Allahabad, raising all his grievances within a period of two weeks from today. In case, any such representation is filed by the petitioner, the respondent no.4 shall consider and decide the same by a reasoned and speaking order preferably within a period of two months thereafter.
The writ petition is disposed of subject to the observations made above.
