The Honourable Mr. Justice ... vs State Rep. By

Madras High Court|07 September, 2017

JUDGMENT / ORDER

Petitioner apprehends disturbance to his property from the second respondent's representatives and hence, has made out an application seeking for police protection. It is seen that the petitioner had purchased the property from one Sekar, who had also earlier approached this Court and by order dated 04.09.2017 in Crl.O.P.No.34115 of 2013, police protection was extended to him for the purpose of safeguarding the property. Since the petitioner's vendor had the benefit of an identical order granting police protection and also the fact that the disturbances seems to be continuing till date, I am of the view that it would be appropriate to grant similar order of protection to the petitioner also.
2. Hence, the Criminal Original Petition stands allowed. Petitioner is granted liberty to approach the respondent police as and when he apprehends any disturbance and on receipt of such representation, the respondent police shall immediately extend the necessary protection, in order to safeguard the petitioner's property, situated at Old Door No. 38, New No.37, Anwarmiyan Gardens, L.B.Road, Adyar, Chennai.
