1. We have heard learned Senior Counsel Mr.B.B.Naik assisted by learned advocate Mr.Parthiv Bhatt for the appellants and learned counsel Mr.Hriday Buch for the respondents.
2. This Letters Patent Appeal has been filed challenging the order dated 06.08.2008 passed in Special Civil Application No.29141 of 2007 by which the learned Single Judge has vacated the interim relief. Initially when the Letters Patent Appeal was filed, interim relief was granted till the next date of listing. However, according to the learned counsel for the appellants, it was extended for some time but thereafter it was not extended. Be that as it may, since the writ petition is pending before the learned Single Judge, interest of justice would be served if the writ petition filed by the appellant itself is decided on merits and the learned Single Judge is requested to decide the matter at the earliest.
3. The appeal is disposed of with a request to the learned Single Judge to decide Special Civil Application No.29141 of 2007 expeditiously. Notice is discharged with no order as to costs.
