Heard learned counsel for the petitioner, learned Standing Counsel and perused the record.
By means of this writ petition, petitioner has prayed for the following reliefs:-
(i) Issue a writ, order or direction in the nature of certiorari quashing the impugned order dated 28.11.2019 passed by District Supply Officer, Chitrakoot.
(ii) Issue a writ, order or direction in the nature of mandamus commanding the respondents to restore the fair price shop license of the petitioner and permit the petitioner to run the fair price shop.
It is contended by learned counsel for the petitioner that fair price shop licence of the petitioner was suspended on 28.11.2019 without affording any opportunity of hearing to the petitioner. It is alleged that by the said order liberty was also granted to the petitioner to submit his reply within a period of seven days. At this stage, learned counsel for the petitioner intends to file detailed reply pursuant to the said suspension order and, therefore, confined his prayer only with respect to an opportunity to approach respondent no. 4 i.e. District Supply Officer, Chitrakoot by means of a representation ventilating all his grievance within a period of ten days from today who in turn be directed to consider and decide the same in accordance with law, to which learned Standing Counsel has no objection.
Having regard to the facts and circumstances of the case, but without prejudice to the merits of the case, the instant writ petition is finally disposed off with the direction that in case the petitioner approaches respondent no. 4 i.e. District Supply Officer, Chitrakoot ventilating all his grievance raised in the instant writ petition along with representation within a period of 15 days from today as also the certified copy of this order, same shall be considered and decided by the authority concerned within a period of one month thereafter in accordance with law after affording an opportunity of hearing to the petitioner.
