1. The learned Principal District Judge, Rajkot has forwarded a communication dated 31st March, 2015 of the learned 4th Additional Senior Civil Judge, Rajkot seeking extension of time for disposal of Regular Civil Suits No.53/2006 and 54/2006 for the reason stated therein.
2. It appears that the learned Judge has failed to understand the nature of the order dated 22nd December, 2014 passed by this court in the captioned special civil applications. The court had not issued any direction to the trial court to conclude the trial within a period of three months. The request was limited to disposing of the applications under Order VII rule 11 of the Code of Civil Procedure, 1908 (hereinafter Page 1 of 2 C/SCA/15142/2014 ORDER referred to as "the Code") within a period of three months.
3. However, it appears that the original plaintiff has expired and hence, it may take some time to bring the heirs on record. Under the circumstances, the time limit for deciding the applications made by the original petitioners under Order VII rule 11 of the Code (Exhibit-123 and Exhibit-104 respectively in the respective suits) is hereby extended for a further period of six months, ( Harsha Devani, J. ) hki Page 2 of 2
