Heard learned counsel for the petitioner and learned Standing Counsel for the respondent nos.1,2 and 3.
With the consent of learned counsel for the parties, the writ petition is disposed of.
The contention of learned counsel for the petitioner is that the respondent nos.4 and 5 have illegally encroached the Gaon Sabha land i.e. Araji No.52Ka, area 0.651 hectare, situated at village Pure Durgee, Tehsil Phoolpur, District Prayagraj.
In this regard, the Lekhpal has submitted his report dated 15.03.2019 requested to the concerned police station to provide force to remove illegal encroachment, however, the police authorities are not taking any steps.
In this regard, the petitioner has approached District Magistrate, Prayagraj as well as Senior Superintendent of Police, Prayagraj, by means of an application dated 22.04.2019 (Annexure 4 and 5 to the writ petition).
Having heard the learned counsel for the parties, the writ petition is disposed of by directing the District Magistrate, Prayagraj to consider the petitioner's application dated 22.04.2019, a copy of which will be filed by the petitioner along with certified copy of this order, and pass appropriate reasoned order, strictly in accordance with law and in case the respondent no.4 and 5 have encroached the public utility land, the illegal encroachment shall be removed by the police personnel as earliest possible preferably within one week from the date of order passed by the District Magistrate, Prayagraj.
The writ petition is disposed of.
