This application u/s 482 Cr.P.C. has been filed seeking the quashing of impugned order dated 26.6.2019 passed by learned Additional Chief Judge, Family Court, Court No.5, Kanpur Nagar as well as the entire proceedings of Case No.411 of 2017 (Smt. Anarkali vs. Heeralal), under sections 125(3) Cr.P.C., Police Station- Kalyanpur, District- Kanpur Nagar.
Heard applicant's counsel as well as learned AGA and perused the record.
It appears that the proceedings challenged are in the nature of execution proceedings. After a particular order has been passed by the Court it has to be complied with. There is nothing wrong about it. Moreover, it has been made to appear that already the original order has been challenged in the Court. It is for that court to decide about the appropriateness of staying the execution or compliance of that order. For this very purpose filing of this separate application under section 482 Cr.P.C. appears to be an anomalous attempt and may result incongruous order.
The application therefore stands dismissed.
