1. Mr. Devendra Pratap Singh has informed this Court that he has wrongly accepted notice on behalf of Respondent No. 4. He is no longer their counsel.
2. The counsel for petitioner says that his limited prayer in this writ petition is a Mandamus be issued to the Respondent No. 4 to release his retiral benefits payable to him as he has retired from the post of Clerk/Cashier in Branch Hathgaon, District Cooperative Bank Limited, District Fatehpur. An additional prayer has been made that the representations made by the petitioner to the Respondent No. 4 may be directed to be decided by him expeditiously.
3. Accordingly, this Court does not deem it appropriate to keep the writ petition pending and issue notice to the Respondent No. 4.
4. The writ petition is disposed off without entering into the merits of the controversy with a direction to the Respondent No. 4 to consider and decide the pending representations of the petitioner for retiral benefits strictly in accordance with law. The Respondent No. 4 shall pass appropriate orders within a period of three months from the date of production of a certified copy of this order and in case certain dues are found admissible to be paid to the petitioner, the same shall be ensured to be paid to the petitioner within one month thereafter.
