1. Mr.
K.M. Patel, learned advocate for the petitioners submits that the issue of proper valuation of the suit, is required to be decided before further proceedings are taken up, particularly, for the reason that not only jurisdiction of the Court to try this suit would depend on basis of valuation of the suit, but the issue about the Appellate forum, also would depend on valuation of the suit.
2. Considering the submissions, issue NOTICE returnable on 22.7.2008. It would be open for the petitioners to make an application for adjournment citing reason that this Court has issued notice in the present petition and the learned Court will appropriately consider the said application.
