Civil Misc. Delay Condonation Application No.04 of 2019 alongwith Civil Misc. Substitution Application No.05 of 2019 A substitution application for substituting the legal heirs of Ramwati, petitioner no.10 who died on 18.03.2012 has been filed alongwith an application for condonation of delay in filing the substitution application.
Sri Suresh Singh, learned Additional Chief Standing Counsel has no objection in condoning the delay.
Considering the aforesaid and for the reasons assigned therein, we are of the view that cause shown in the delay condonation application is sufficient to condone the delay.
Accordingly, the delay in filing the substitution application is condoned and the substitution application is allowed.
Civil Misc. Withdrawal Application No.06 of 2019 The is an application of withdrawal filed on behalf of the legal heirs of petitioner no.10.
On due consideration the prayer is allowed.
Accordingly, the writ petition is dismissed as withdrawn on behalf of petitioner no.10.
It is made clear that the writ petition still survives on behalf of the remaining petitioners.
