Heard learned counsel for the petitioner.
Present petition has been filed for setting aside the order dated 16.2.2019 passed by the Additional District Judge, Ballia in Civil Appeal No. 207 of 2012 (Haushila and others vs. Smt. Rikhmuni Devi and others) as well as order dated 30.10.2012 passed by Civil Judge (J.D.), East Ballia in Civil Suit No. 986 of 2012 (Haushila and another vs. Smt. Rikhmuni Devi and others).
By the impugned order dated 30.10.2012 the trial court rejected the interim injunction application on the ground that there exists registered sale deeds in favour of the defendants. The suit is for cancellation of sale deeds. Misc. appeal filed by the plaintiff-petitioner was also dismissed for the same reason.
Admittedly, the registered sale deed is existing in favour of the defendants.
In such view of the matter, I do not find any legal infirmity in the order impugned herein.
The suit is of the year 2012.
In the facts and circumstances of the case, the court below is directed to expedite the hearing of the aforesaid suit and decide the same, in accordance with law, expeditiously.
With the aforesaid observation, present petition stands dismissed.
