JUDGMENT / ORDER

The petitioner, who is the petitioner in M.C.No.21/12 on the file of the court of Judicial First Class Magistrate- Karunagappally, preferred the above O.P. under Article 227 of the Constitution of India, with a prayer to direct the learned Magistrate to dispose of Ext.P1 at an earlier date.
2. Heard the learned counsel for the petitioner and the learned Public Prosecutor.
3. When the above case came up for admission on 27.8.2014, this Court directed the registry to obtain a report from the Presiding Officer of the court below about the pendency of the cases in the said court and the possible and probable date on which M.C.No.21/12 can be disposed of. Accordingly, the learned Magistrate by his letter No.MC(DV).21/12 dated 16.9.2014 informed this Court that O.P.(Crl.)No.183 of 2014 2 as on 1.9.2014, altogether 10,078 cases are pending in that court and as per the target approved by this Court, the cases upto the year 2010 are included in the target.

Under the above circumstances, according to me, this Court will not be justified in issuing any direction to the court below to dispose the above M.C. within a time limit, since it will amounts to stress upon the court below, particularly when as per the target fixed, only the cases upto 2010 are included. So, the prayer of the petitioner as such, cannot be allowed and no direction as prayed for, can be issued. However, I have no hesitation to observe that the learned Magistrate will take appropriate steps to expedite the trial in M.C.No.21/12 and dispose the same as expeditiously as possible.
