Learned counsel for the appellant and learned counsel for respondent no.1 are present.
As per office report dated 22.04.2019 10.07.2019, statutory deposit of Rs.25,000/- (twenty five thousand) have been made by the appellant and notices were issued to respondent nos. 2 to 6 by R.P.A.D as well as by courier services, have neither received back nor anyone has put their appearance on behalf of respondent nos. 2 to 6.
Service of notices issued to respondent nos. 2 to 6 is deemed to be sufficient.
Heard learned counsel for the appellant, learned counsel for respondent no. 1 and perused the record as well as supplementary affidavit.
As per office report, this appeal has been filed by the appellant (Haryana Roadways, Sonipat Depot, Haryana), by delay of one year and one hundred fifty days.
Learned counsel for the appellant submits that the delay in filing the appeal was caused due to non-communication of impugned award by the learned counsel for appellant as well as due to official communication.
Learned counsel for the respondents vehemently opposed the submission made by learned counsel for the appellant and has further submitted that the delay has been caused deliberately in filing the present appeal.
The justification of delay for filing the appeal has been sufficient.
Application allowed. Delay condoned. Office to allot regular number.
