1. Called in revise. None appeared to press this revision. In the circumstances, I myself have perused the record.
2. This criminal revision under Section 397/401 Cr.P.C., has been filed aggrieved by the judgment and order dated 02.09.1994 passed by Sessions Judge, Saharanpur. The IV-Additional Chief Judicial Magistrate, Saharanpur vide order dated 29.04.1994 convicted revisionists and sentenced them to undergo two years rigorous imprisonment under Section 325 IPC and six months rigorous imprisonment under Section Section 323 IPC with fine of Rs.1,000/- each. Thereagainst, revisionists preferred Criminal Appeal No. 34 of 1994 and Appellate Court while allowing appeal partly confirmed order of conviction passed by Trial Court except the sentence awarded to revisionist- Mahipal in respect of offence punishable under Section 325 IPC is maintained and set aside the sentence awarded to appellants-Hariya and Naipal in respect of offence punishable under Section 325 Cr.P.C. Being aggrieved the revisionist preferred present revision.
3. Having gone through the record, I do not find any manifest error or otherwise illegality, procedural or otherwise, so as to justify interference in criminal revision.
4. Dismissed. Interim order, if any, stands vacated.
5. Certify this judgment to the lower Court immediately.
