The suspension order under challenge has been passed in contemplation of the disciplinary enquiry after a preliminary enquiry made by the respondent. It is admitted that the notice was issued to the petitioner prior to passing of the suspension order.
The contention of learned counsel for the petitioner that the petitioner has no concern with the allegations levelled in the suspension order cannot be examined in the Writ jurisdiction. It is open for the petitioner to submit his reply to the chargesheet, as soon as the same is served on him.
At this stage, learned counsel for the respondent submits that the department shall serve chargesheet on the petitioner within a period of 15 days from today, if not already served.The petitioner shall submit his reply within further period of three weeks.
All efforts shall be made to conclude the departmental enquiry at the earliest, preferably, within a period of three months from the date of receipt of reply to the chargesheet, provided the petitioner cooperates.
