Heard learned counsel for the petitioners and learned AGA for the State-respondent.
The present petition has been filed seeking for quashing of the first information report dated 18.03.2021 registered as Case Crime No. 71 of 2021, under sections 498-A, 323, 307, 506 I.P.C. and Section 3/4 of Dowry Prohibition Act, P.S- Inchauli, District- Meerut.
At the outset, learned counsel for the petitioners submits that the petitioner no.1, husband of victim- Suman, is ready to settle the dispute amicably through the process of mediation.
Submission is that no other matrimonial dispute is pending between the parties.
Be that as it may, looking to the fact that the dispute is primarily matrimonial in nature, we are of the opinion that the parties may be given a chance to settle their dispute in an amicable manner.
It is, therefore, provided that the matter be referred to the Mediation and Conciliation Centre, Meerut. The petitioner no.1 shall deposit an amount of Rs. 25,000/- before the Mediation and Conciliation Centre, District Meerut within a period of two weeks from today.
Subject to the said deposit, notice be issued to respondent no.3 intimating the date of appearance before the Mediation and Conciliation Centre. An amount of Rs. 20,000/- shall be paid to the wife of the petitioner no.1 on the date of her first appearance before the Mediation and Conciliation Centre. This order be intimated to the District Judge, Meerut to refer the matter to the Mediation and Conciliation Centre, Meerut.
For a period of six months or till the matter is resolved through the process of mediation, whichever is earlier, no coercive measure shall be taken against any of the petitioners in the aforesaid case.
In view of the above, the present petition is disposed of.
