THE HON'BLE MR JUSTICE C.V.NAGARJUNA REDDY WRIT PETITION No.17454 of 2007 ORDER:
This writ petition is filed for a Mandamus to declare the inaction of the respondents in acting on the petitioner’s complaint dated 27.11.2006, as illegal and arbitrary.
I have heard the learned counsel for the petitioner and perused the record.
By representation dated 27.11.2006, the petitioner is stated to have requested respondent No.2 to initiate appropriate action against one B. Sudheer Kumar Reddy, Proprietor of a construction company to prevent him from forcibly entering into his land and removing the boulders therein through blasting. The grievance of the petitioner is that no action was taken by the police on the said representation.
Though this writ petition was filed as far back as August 2007, no interim order has been granted so far. At the hearing, the learned counsel for the petitioner is unable to state whether the cause, on which the writ petition was filed, still survives. With the passage of nearly 3 years time, it is reasonable to presume that the issue will not be surviving.
In this view of the matter, the writ petition is disposed of as infructuous. However, if the cause continues to survive in future, the petitioner is entitled to avail appropriate remedies.
As a sequel to disposal of the writ petition as infructuous, WPMP.No.22349 of 2007 filed by the petitioner for interim relief is disposed of as infructuous.
