THE HON'BLE MR JUSTICE C.V.NAGARJUNA REDDY ORDER:
WRIT PETITION No.15427 of 2007 This writ petition is filed for a Mandamus to direct the respondents to take immediate action against respondent No.11 for missing of Sri Harijan Tokala Sailu, son of Sri Masaiah and hold an enquiry into the said incident.
The petitioner’s husband was stated to have been taken as a bounded labourer from his village by respondent No.1 contractor in the year 2004 and that he failed to return to the village though other labourers, who were taken with him, have returned. The grievance of the petitioner is that the representation given by her to the respondents has not yielded any result.
At the hearing, the learned Assistant Government Pleader for Home, on instructions, submitted that the representation of the petitioner was treated as a complaint and Crime No.263 of 2006 was registered on 25.08.2006 and that after a thorough investigation, the case was closed on 31.10.2007, as the missing person could not be traced.
In the counter affidavit filed by the Tahsildar, Jadcherla Mandal, Mahaboobnagar District, respondent No.7, it is stated that the Village Revenue Officers in each village have been maintaining information of migrated labourers since their establishment from February 2007, that all the bounded labourers, who are identified as such, were released from the bondage and rehabilitated under various schemes such as providing Milch Animals, Sheep Rearing Units, Bullock Carts and Agricultural Lands as re-settlement measures. It is further stated that the police have made all efforts to trace the missing person after registering the case.
No reply affidavit is filed controverting the above averments contained in the counter affidavit.
In view of the stand taken by respondent Nos.7 and 9, as noted above, no relief can be granted in this writ petition. The writ petition is accordingly dismissed.
As a sequel to dismissal of the writ petition, WPMP.No.19497 of 2007 filed by the petitioner for interim relief is also dismissed.
